Brunei Minimum Wage Order 2025: What Employers and Employees Need to Know

The Employment (Minimum Wage) Order, 2025 introduces legally enforceable minimum wage requirements for companies listed under specific industries. If your company is covered, this Order requires timely action to ensure employees are paid at least the new minimum rate and that contracts and records are updated accordingly.

Who is affected?

  • Employees: If you work in a company listed under the industries identified in the Order and you’re currently earning below the minimum wage, your employer must adjust your wage to meet the new minimum.
  • Employers: Only companies in the listed industries are required to comply. If your company/industry is not listed, the Order does not apply to you at this time.

What employers must do after the announcement (before full enforcement)

  • Renew contracts: Issue revised employment contracts reflecting the minimum wage rate. Both employer and employee must sign.
  • Keep and provide records: Retain the re-signed contract and give the employee a copy.
  • Submit declaration: Complete the required Declaration form and send it to led@buruh.gov.bn.

If your company isn’t listed under the Order

  • The Order does not currently apply to your company or industry.
  • You may refer to the Salary Guideline (2023 Edition) for recommended minimum salary scales to build competitive packages, but it’s not mandatory.

Why these matters

  • Legal compliance: Ensures wages meet the mandated minimums where applicable.
  • Clarity and fairness: Formalized, signed contracts protect both employer and employee.
  • Accountability: Record-keeping and declaration submission demonstrate compliance.
